These Terms govern your use of SmartBrain ("the Service"), operated by SmartBrain / Ask Amélie. By creating an account or installing the SmartBrain app on a third-party platform (such as GoHighLevel, ManyChat, Shopify or others), you agree to these Terms.
SmartBrain connects to your existing chatbot, CRM or messaging setup and adds customer memory, catalog knowledge, product recommendations and rich replies. SmartBrain does not replace your existing flows; it augments them.
You are responsible for keeping your API key confidential and for all activity under your account. One API key identifies one business/tenant; you must not share keys across unrelated businesses.
You agree not to use the Service to send spam, unlawful, deceptive, harassing or infringing content, nor to attempt to access other tenants' data or disrupt the Service. You are responsible for the accuracy of the catalog and content you provide.
Paid plans are billed in advance on a recurring basis via Stripe. You can upgrade, downgrade or cancel at any time from your dashboard; cancellation stops future renewals and takes effect at the end of the current period. Fees already paid are non-refundable except where required by law.
The Service is provided "as is" without warranties of any kind. AI-generated replies may contain errors; you are responsible for reviewing automated messaging used with your customers.
To the maximum extent permitted by law, SmartBrain's total liability for any claim is limited to the amount you paid in the 3 months preceding the claim.
You may stop using the Service at any time. We may suspend accounts that violate these Terms or applicable platform policies.
